These Terms and Conditions (“Terms”) govern the use of the websites operated by BEREZIN LLC DBA A11 Appliance Repair (“A11 Appliance Repair,” “we,” “us,” or “our”) at https://a11appliancerepair.com/ and https://a11ar.com/ (collectively, the “Websites”), and the provision of appliance repair services (“Services”) to our customers (“Customer,” “you,” or “your”).
By using our Websites or contracting our Services, you agree to these Terms. Please read them carefully.
1. Acceptance of Terms
By accessing our Websites, requesting an estimate, or submitting payment to A11 Appliance Repair, you agree to these Terms, including any future updates. If you do not agree, please do not use our Websites or Services.
It is your responsibility to familiarize yourself with these Terms before allowing our technician to commence work. Acceptance of service constitutes acceptance of these Terms.
2. Services Provided
We provide residential and commercial appliance repair services. These Terms do not cover industrial services.
3. Non-Refundable Diagnostic Fee
We charge a non-refundable diagnostic fee (“Diagnostic Fee”) for non-warranty visits to your residence or business. The Diagnostic Fee will be quoted to you before our visit and covers travel expenses and diagnostic services by a trained technician.
By proceeding with our Services, you agree to:
Pay the Diagnostic Fee in full, regardless of whether you approve the recommended repairs.
Apply the Diagnostic Fee toward the cost of the repair if you authorize A11 Appliance Repair to perform the recommended work.
4. Estimates and Price Quotes
The estimate section of your Service Order outlines the estimated costs (“Price Quote”) for parts and services required to repair your appliance(s) or electrical system(s). By approving the Service Order, you agree to the Price Quote and scope of work.
The final cost may vary if additional labor or parts are required beyond the initial estimate. Any changes will be communicated and must be approved by you before proceeding.
Applicable sales tax is included in the Price Quote.
5. Payment Terms and Collection Costs
Payment is due in full upon completion of Services unless otherwise agreed in writing. Accepted payment methods include check, cash, or credit card.
Dishonored checks or bank drafts will incur a $25.00 processing fee.
Unpaid balances will accrue interest at an annual rate of 18%, or the maximum allowed by law, whichever is lower.
You agree to pay all costs incurred by A11 Appliance Repair in collecting unpaid amounts, including attorney fees, filing fees, and court costs.
Customers agree that any payment disputes must be resolved directly with A11 Appliance Repair before initiating a chargeback. Unauthorized chargebacks will incur a $50 processing fee.
6. Limited Warranty
A11 Appliance Repair warrants that repairs, parts, and services provided will be free from defects in material and workmanship for:
90 days from the date of repair or service for COD repairs.
One year for major equipment installations.
If you discover a defect within the warranty period, you must notify A11 Appliance Repair in writing. Our obligation and your exclusive remedy is limited to replacing defective parts or workmanship, or refunding the amount paid for said service and parts. Warranty claims are subject to inspection and approval by A11 Appliance Repair.
7. Exclusions from Warranty
This warranty does not cover:
Misuse, neglect, or improper maintenance by the Customer.
Third-party repairs or modifications after A11 Appliance Repair’s service.
Cosmetic or non-functional parts (e.g., trim, racks, shelves, door liners).
Appliances moved from the original repair location.
Damage from power surges, floods, earthquakes, or other acts of God.
Parts no longer available from the manufacturer.
Warranty coverage is void if the Customer has any unpaid amounts due.
8. Disclaimer of Warranties
THE WARRANTIES SET FORTH HEREIN ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. WARRANTIES EXTEND ONLY TO THE ORIGINAL CUSTOMER.
9. Limitation of Damages
A11 Appliance Repair shall not be liable for any special, incidental, indirect, or consequential damages arising from breach of warranty, breach of contract, negligence, or any other legal theory. Our liability is limited to the amount actually paid by the Customer. THIS LIMITATION DOES NOT APPLY TO CLAIMS FOR PERSONAL INJURY.
10. Arbitration and Dispute Resolution
All claims and disputes arising under these Terms or related to our Services shall be resolved by binding arbitration in Los Angeles County, California, under the Commercial Arbitration Rules of the American Arbitration Association. Disputes under $5,000 may be brought in small claims court.
You waive the right to participate in any class action lawsuit against A11 Appliance Repair. Arbitration decisions shall be in writing, include an explanation of the decision, and may be confirmed in a court of competent jurisdiction.
11. Damage Waivers
You acknowledge and accept the following waivers of liability:
a. Waiver of Damages When Moving Appliances or Electrical Components:
Moving appliances or electrical components involves inherent risks. By requesting movement, you assume responsibility for any incidental damage to machines, flooring, cabinetry, or countertops and release A11 Appliance Repair from any liability, except in cases of gross negligence.
b. Waiver of Damages When Working with Water:
Repairs connected to plumbing systems carry risks of leaks or flooding. Except for cases of gross negligence, A11 Appliance Repair is not liable for damages resulting from such issues.
c. Waiver of Damages from Failed Cooling or Heating Equipment:
Refrigeration and HVAC repairs involve complex systems that may fail despite repair efforts. We are not responsible for food spoilage, revenue loss, or other indirect damages resulting from such failures.
d. Waiver of Damages from Lifting Glass Cooktops:
Lifting glass or ceramic cooktops may result in breakage due to strong adhesives. While our technicians exercise care, we do not accept liability for breakage that may occur during necessary service work.
12. Homeowners Association (HOA) Notification Responsibility
It is your responsibility to notify and obtain approval from your Homeowners Association (HOA) before work begins. A11 Appliance Repair is not liable for disputes or penalties arising from your failure to obtain such approvals.
13. Entire Agreement
These Terms, along with any Service Order or invoice, constitute the entire agreement between A11 Appliance Repair and the Customer. This agreement supersedes all prior agreements, written or oral.
14. Governing Law
These Terms and any disputes shall be governed by and interpreted in accordance with the laws of the State of California.
